These Terms of Service ("Terms") govern your access to and use of the website located at healingbluetherapy.com (the "Website") and the therapy, counseling, evaluation, and related services (the "Services") offered by Healing Blue Inc., doing business as Healing Blue Therapy ("Healing Blue," "we," "us," or "our"), including services provided in person at our Granada Hills, California office and via telehealth throughout California.

By visiting the Website, submitting a contact or consultation request, scheduling an appointment, or receiving Services from Healing Blue, you ("Client," "you," or "your") agree to be bound by these Terms. If you are completing this on behalf of a minor client, "you" also refers to you in your capacity as parent or legal guardian, and you represent that you have the legal authority to consent to treatment for that minor. If you do not agree to these Terms, please do not use the Website or Services.

1. Nature of Services

Healing Blue provides individual outpatient psychotherapy and related mental health services, which may include but are not limited to: individual therapy, online (telehealth) therapy for California residents, EMDR therapy, teen therapy, and specialized care related to anxiety, depression, trauma, prenatal and postpartum concerns, self-esteem, people-pleasing, social anxiety, and related areas. Services are provided in English and Spanish by qualified clinicians.

Services are provided by licensed and/or supervised associate mental health professionals authorized to practice in the State of California. Information about a specific clinician's license type, license number, and supervision status (if applicable) is available upon request and is generally provided at intake, consistent with California Board of Behavioral Sciences and Board of Psychology requirements.

1.1 Immigration Evaluations

Healing Blue offers psychological evaluations that may be used to support certain immigration proceedings (for example, hardship or asylum-related evaluations). These evaluations are clinical assessments only. Healing Blue does not provide legal advice, does not represent clients before any immigration court or agency, and cannot guarantee any particular outcome in an immigration matter. Clients seeking an immigration evaluation should work with a qualified immigration attorney regarding the legal aspects of their case.

2. Not for Emergencies — Crisis Situations

Healing Blue is an outpatient practice and does not provide 24-hour, immediate, or emergency crisis care. Our online scheduling, contact forms, email, text messaging, and voicemail are not monitored continuously and must never be used to report a medical or psychiatric emergency.

If you or someone else is in immediate danger, in crisis, or experiencing a medical emergency, do not wait for a response from Healing Blue. Instead:

  • Call 911 or go to your nearest emergency room.

  • Call or text the 988 Suicide & Crisis Lifeline (dial or text 988), available 24/7.

  • Contact your local county mental health crisis line or urgent care psychiatric services.

Between scheduled sessions, response times to messages may take up to 1–2 business days. Some clinicians may not be reachable outside of scheduled session times.

3. Eligibility and Location Requirements

You must be at least 18 years old to independently agree to these Terms and to consent to your own treatment, except where California law permits minors to consent to specific types of mental health treatment on their own behalf. For clients under 18, a parent or legal guardian with the legal authority to consent to treatment must complete intake paperwork and agree to these Terms on the minor's behalf, consistent with our Minor Consent and Confidentiality policies provided separately at intake.

Telehealth (online) Services are available only to clients who are physically located within the State of California at the time of each session, consistent with California licensure law. You agree to inform your clinician if you will be located outside California at the time of a scheduled telehealth session, as we may be unable to provide services under those circumstances.

4. Scheduling, Cancellations, and No-Shows

Appointments are scheduled directly with your clinician or through our intake process. We ask that you provide at least 24 hours advance notice if you need to cancel or reschedule an appointment.

  • Late cancellations (less than the required notice) and missed appointments ("no-shows") may be subject to a cancellation fee of the cost of a session.

  • Repeated late cancellations or no-shows may result in a discussion about the appropriateness of continuing services and, if necessary, referral to another provider.

  • Fees related to cancellations and no-shows are generally not reimbursable by insurance and are the client's responsibility.

5. Fees, Payment, and Insurance

Current fees for consultations and sessions are provided during intake and/or posted on the Website and are subject to change with reasonable notice. Payment is due at the time of service unless another arrangement has been made in writing.

Healing Blue's participation with insurance panels, if any, and the availability of superbills for out-of-network reimbursement, will be discussed during intake. You are responsible for understanding your own insurance benefits, including any deductibles, co-payments, coinsurance, or session limits, and for any fees not covered by insurance. Under the federal No Surprises Act, clients who are uninsured or self-pay have the right to receive a Good Faith Estimate of expected charges for services prior to receiving care, upon request.

A free 15-minute initial consultation may be offered to prospective clients to determine fit before any fee-based services begin, as described on the Website.

6. Telehealth Terms

If you receive Services via telehealth (video or phone session), you acknowledge and agree that:

  • Telehealth involves the use of interactive audio-video or audio-only technology to deliver mental health services when you and your clinician are not in the same physical location.

  • You are responsible for ensuring a private, confidential location and a stable internet connection for each session. Healing Blue is not responsible for breaches of privacy that occur due to your chosen location or device.

  • As with any technology, there is some risk of technical failure, interruption, or unauthorized interception, although we use industry-standard, HIPAA-compliant platforms to reduce this risk.

  • At the start of telehealth services, you will be asked to provide your current physical location and an emergency contact, and to identify the nearest emergency facility to your location, in case of a crisis during a session.

  • Telehealth may not be appropriate for all conditions or all clients; your clinician will discuss with you if in-person or a higher level of care is recommended instead.

7. Confidentiality and Its Limits

Communications between you and your clinician are generally confidential and protected under California law (including Evidence Code § 1010 et seq., governing the psychotherapist-patient privilege) and the Health Insurance Portability and Accountability Act (HIPAA). Details on how your protected health information is collected, used, and disclosed are described in our Notice of Privacy Practices and Privacy Policy, available on the Website.

California law requires or permits disclosure of otherwise confidential information in certain limited circumstances, including but not limited to:

  • Suspected abuse or neglect of a child, elder, or dependent adult, which clinicians are mandated by law to report.

  • A good-faith belief that you present a serious danger of violence to a reasonably identifiable victim (duty to protect/warn, per Tarasoff and California Civil Code § 43.92).

  • A serious risk of suicide or self-harm requiring intervention to protect your safety.

  • Circumstances where disclosure is required by a court order or applicable law.

  • Coordination of care with other treating providers, insurance billing, or clinical supervision, generally only with your authorization or as otherwise permitted by law.

These limits on confidentiality will be reviewed with you in more detail as part of your informed consent to treatment at intake.

8. Electronic Communication

Email, text messaging, and client portal messaging are offered for scheduling and administrative convenience only. Standard email and text messages are not fully secure or encrypted end-to-end unless otherwise stated, and confidentiality cannot be guaranteed for these channels. Please avoid sending sensitive clinical content by unsecured email or text, and never use these channels to report an emergency.

9. SMS / Text Messaging Program

As part of the Services, Healing Blue offers an optional SMS/text messaging program to clients and prospective clients who provide a mobile phone number and affirmatively opt in (for example, through our online contact/intake form, a verbal opt-in confirmed during a consultation call, or another clear opt-in method). Messages sent through this program may include:

  • Appointment reminders and confirmations.

  • Scheduling and rescheduling communications.

  • Intake, billing, or paperwork follow-ups.

  • General administrative updates about your care (for example, a change in office hours or a clinician's availability).

Opting in to SMS messaging is entirely voluntary and is never a condition of receiving therapy, evaluation, or any other Service from Healing Blue. Standard message and data rates may apply based on your mobile carrier and plan, and message frequency will vary depending on your scheduling activity.

To stop receiving text messages at any time, text STOP to the number you received messages from, or contact us directly at (818) 626-3717. You will receive a one-time confirmation that you have been unsubscribed, and no further messages will be sent unless you opt in again. For help, text HELP to the same number, or call us directly.

Mobile carriers are not responsible or liable for delayed or undelivered messages. Message delivery is subject to the effective transmission from your mobile carrier and factors outside our control, including network coverage and device compatibility. Healing Blue does not guarantee the delivery, timeliness, or receipt of any text message and encourages clients not to rely on SMS as the sole method of receiving time-sensitive appointment information. 10. Client Responsibilities

To support a safe and effective therapeutic relationship, you agree to:

  • Provide accurate information about yourself, including identity, contact information, and relevant health history.

  • Attend sessions as scheduled and provide timely notice of cancellations.

  • Engage respectfully with your clinician and Healing Blue staff; verbal abuse, threats, or harassment may result in termination of services.

  • Understand that therapy is a collaborative process and that outcomes depend in part on your engagement, and that Healing Blue makes no guarantee of any specific result, diagnosis, or outcome from Services.

11. No Guarantee of Outcome; Professional Judgment

Therapy and psychological evaluation are collaborative processes, and outcomes vary based on many factors outside our control. Healing Blue does not guarantee that any particular Service, technique (including EMDR), or evaluation will resolve a specific concern, achieve a specific result, or be accepted by any third party (including immigration authorities, courts, employers, or other agencies). Your clinician exercises independent professional clinical judgment regarding your care and may, at their discretion, refer you to a higher level of care, a specialist, or another provider if they determine that is in your best interest.

12. Termination of Services

You may discontinue services at any time. We ask that, where possible, you discuss ending treatment with your clinician so that appropriate closure and, if needed, referrals can be provided.

Healing Blue reserves the right to terminate or suspend services to any client for reasons including, but not limited to: nonpayment of fees, repeated missed appointments, safety concerns, conduct that is abusive or threatening toward staff, or a clinical determination that our services are not an appropriate fit for your needs. Where appropriate and safe to do so, we will provide referrals to alternative providers.

13. Use of the Website

The Website is provided for general informational purposes about Healing Blue and its Services. Content on the Website, including blog posts and specialty pages, is educational in nature and does not constitute individualized clinical advice, a therapist-client relationship, or a diagnosis. A therapist-client relationship is established only after you complete intake and formally begin services with a Healing Blue clinician.

You agree not to misuse the Website, including by attempting to gain unauthorized access to any portion of it, introducing malicious code, scraping content without permission, or using the Website's contact forms for unlawful or fraudulent purposes.

14. Intellectual Property

All content on the Website, including text, graphics, logos, images, and the Healing Blue name and branding, is owned by Healing Blue Inc. or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws. You may view and share Website content for personal, non-commercial purposes, but may not reproduce, distribute, modify, or create derivative works from it without our prior written consent.

15. Third-Party Links and Services

The Website may contain links to third-party websites or use third-party scheduling, payment, or telehealth platforms. Healing Blue does not control and is not responsible for the content, policies, or practices of third-party sites or services. Your use of any third-party service is subject to that provider's own terms and privacy policy.

16. Limitation of Liability

To the fullest extent permitted by applicable law, Healing Blue Inc., its owners, clinicians, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Website or Services, or your reliance on any information provided through the Website, except where such liability cannot be limited or excluded under applicable California law. Nothing in these Terms is intended to limit any liability that cannot lawfully be limited, including liability arising from gross negligence, willful misconduct, or violation of applicable professional standards of care.

17. Dispute Resolution and Governing Law

These Terms, and any dispute arising from or relating to the Website or Services, shall be governed by the laws of the State of California, without regard to its conflict-of-laws principles. Material changes affecting active clients will be communicated directly where appropriate.

19. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.
